NACP says no need to include war-related aid in asset declarations

The National Agency on Corruption Prevention (NACP) has clarified that Ukrainians do not have to declare financial assistance received from other countries and international organizations because of the war.

The relevant statement was made by the NACP, Ukrinform reports.

"Is it necessary to declare aid from international organizations and other states? No, it is not. Regardless of whether you stayed in Ukraine or abroad at the time you received this assistance, you do not need to declare it," the NACP said.

If a person has already filed a declaration containing information on monetary payments (financial assistance) from international organizations and foreign countries, this will not entail legal consequences. Citizens do not need to specify the payments in the next asset declaration for 2023.

At the same time, this applies only to declarations whose reporting period fully or partially falls within the period of martial law.

Thus, the NACP emphasized, if the aid was paid at the expense of foreign states (in particular, payments to Ukrainians who went abroad due to Russia's full-scale invasion of Ukraine), except for funds received from Russia, or if the aid came from international organizations (for example, the UN World Food Program, the UN High Commissioner for Refugees, UNICEF, and the International Committee of the Red Cross Mission in Ukraine), it does need to be declared.

"Does financial aid from Ukraine need to be declared? Yes, it does. Such assistance must be declared. In particular, this applies to financial assistance provided to internally displaced persons (IDPs) from the state, including applications submitted through the eDopomoga platform," the agency added.

It can also include covering living expenses (IDP living allowance), compensation for expenses related to free temporary accommodation (stay) of IDPs, financial assistance to civilians who are evacuated, or financial assistance to civilians in de-occupied settlements.

In the asset declaration, the NACP recommends indicating the Cabinet of Ministers of Ukraine as the source of income for such funds (by blocking the field for entering the EDRPOU code).

As reported, the Verkhovna Rada intends to adopt a law to restore electronic declaration and return full powers to the National Agency on Corruption Prevention.

In May 2022, the NACP stated that officials did not have to file asset declarations during martial law.

Draft Law No. 8071, which restores the process of submitting and verifying electronic declarations, is currently under consideration in the Ukrainian parliament.
