Law enforcement agencies will limit business inspections - Svyrydenko

The National Security and Defense Council has recommended that law enforcement agencies refrain from actions that could block or have a significant negative impact on the operation of enterprises for three months.

According to Ukrinform, this was reported on Facebook by Vice Prime Minister and Minister of Economy Yuliia Svyrydenko.

"The main thing I want to convey is that the economic bloc of the government and business are on the same side. I am ready to fight for every entrepreneur personally. Today, after discussions with business, in the government circle and at the National Security and Defense Council, President Volodymyr Zelensky announced practical steps that can stabilize the situation," she wrote.

The first step, according to the official, is that the government will submit to parliament a bill to amend the law on the Bureau of Economic Security to strengthen its mechanisms. It is also proposed to change the norms of the Criminal Procedure Code, the laws "On Operational and Investigative Activity," "On the Basic Principles of State Financial Control in Ukraine," and "On the Organizational and Legal Framework for Combating Organized Crime."

"The ultimate goal is to establish additional guarantees to protect business interests during searches and other procedural actions. In addition, the changes will allow consolidating the work on crimes that encroach on the state's economy in a single body - the Bureau of Economic Security," Svyrydenko explained.

It is also proposed to amend the law "On Defense Procurement" to regulate the maximum level of profit for state contracts that were or are being executed during martial law.

The second step is to establish a Business Support Council under the President for the period of martial law. This council will respond to complaints from entrepreneurs and solve urgent problems.

"Third, inspections of business by law enforcement agencies will be limited. The Office of the Prosecutor General, the State Bureau of Investigation, the National Police of Ukraine, the Security Service of Ukraine, and the Bureau of Economic Security of Ukraine will be recommended by the National Security and Defense Council to refrain from searches, detentions, and blocking accounts for three months if such actions block or significantly negatively affect the operation of the enterprise. In addition, they will have to conduct an audit of the measures already taken and whether it is advisable to continue to apply them," the Vice Prime Minister said.

The National Security and Defense Council also recommended that the Prosecutor General's Office, the Security Service of Ukraine, the State Bureau of Investigation, the National Police, and The Bureau of Economic Security conduct an audit of registered criminal proceedings that could potentially jeopardize the state's economy. In addition, they will have to develop mechanisms to protect business from possible abuse or pressure from law enforcement agencies, in particular during procedural actions.

According to Svyrydenko, the Cabinet of Ministers will have to develop an analytical module for the Unified Register of Pre-trial Investigations, which will provide public access to analytical summarized data on the work of law enforcement and prosecutors. It will also be possible to file a complaint about the activities of law enforcement.

"In addition, the government will audit the system of monitoring risks and criteria for blocking tax invoices and procedures and criteria for unblocking them," Svyrydenko summarized.

As reported, Volodymyr Zelensky said that Ukraine would form a Council for Entrepreneurship Support, which will include business representatives.
